Prof. Luke Milligan signs on to two amicus briefs submitted to Supreme Court

Brandeis School of Law Professor Luke Milligan participated in amicus briefs in two cases pending before the U.S. Supreme Court.

He was invited to join the “Originalist Scholars” brief in Microsoft Corp. v. United States (the “Microsoft Ireland Case”). The Microsoft Ireland Case addresses whether the government can compel companies to turn over customer emails stored on servers outside the United States. 

Milligan also was invited to join the “Originalist Scholars” brief in Carpenter v. United States, which addresses the Fourth Amendment rules for cell-site location information. The Carpenter brief relies heavily on Milligan’s scholarship on the original public meaning of the amendment’s right "to be secure." He argues that the Fourth Amendment sought to protect not simply the right to be “spared” unreasonable searches and seizures, but also the right to be “free from fear” of such intrusions.
