Prof. Levinson and students to be published in Harvard Journal on Legislation

Professor Ariana Levinson, along with third-year Brandeis Law students Travis Fiechter and Alyssa Hare, will be published in an upcoming issue of the Harvard Journal on Legislation.

Their article, “Federal Preemption of Local Right-to-Work Ordinances,” argues that the right-to-work ordinances being enacted by counties and cities are preempted by by a federal statute, the National Labor Relations Act (NLRA).

"The article contributes two distinct benefits to the negligible and outdated academic discussion of this important topic. First, the article is an in-depth exploration of NLRA preemption, without consideration of state law, which permits the issue to be treated more completely than ever before," states the article's abstract. "Second, it provides a modern view of an issue that has been largely ignored for twenty-five years."

Levinson and her students are working to finish the article, which can be viewed in draft form now.
