- it occured outside the institution’s jurisdiction as defined by the Sexual Misconduct Policy.
- if proven wouldn’t meet definition of sexual misconduct.
- Meet with the complaintant.
- Meet with the respondent.
- Meet with witnesses who are presented by either party and/or identified through interviews.
- Gather other evidence as able which could include social media posts, text messages, and other information.
- Investigator will provide a preliminary report to both parties for review and response.
- Investigator issues a final report of facts gathered, and statement of whether the complaint will be dismissed or proceed to a hearing.
Dismissal of Case
A complaint claim must be dismissed if:
A complaint may also be dismissed if the complainant withdraws the complaint, the respondent leaves their role at the university i.e. student, faculty, staff, etc., or there are specific circumstances that prevent the University from gathering evidence sufficient to reach a determination.
