Satellite Communications Policy & Procedures

Programming relayed via communications satellites in stationary earth orbit may be received by Information Technology (IT) and redistributed to Belknap and Health Sciences Campuses via the University's cable television systems and Instructional Television Fixed Service (ITFS).

Service Priority
Requests are accepted on a first-come-first-served basis. Priority is given to programming carried under established contract, consortia, or network arrangements in which the University of Louisville is a participant or holds membership and as IT facilities and personnel are available. Further priority consideration is given to:

1) Instructional programs granting UofL credit
2) Continuing Education instructional programs granting UofL CEU's
3) Faculty/staff development
4) Administrative functions
5) Student support services of an instructional nature
6) Educational functions where no admission or registration fees are charged aside from established tuition fees
7) UofL sponsored projects with organizations that are instructional or cultural in nature.

Programs in the instructional category will be billed at the instructional rate in accordance with UofL IT cost recovery requirements. Consumable supplies will be billed at full cost.

Note: Equipment is not available to entities not affiliated with the University of Louisville, other Kentucky Higher Education Institutions, Public School Systems, State agencies, Federal agencies or for personal use.

Open Circuit Viewing: Requests for open circuit viewing, as permitted within the aforementioned regulation of satellite communications, where antennas are fixed on a particular satellite to receive programming of a generally instructional nature such as foreign language news shall be considered on an individual basis. Cost recovery rates will be determined to the extent IT engineering staff time and facilities are involved.

IT Services
IT will assist teleconference users to obtain viewing room arrangements, technical engineering provisions and supporting audiovisual equipment. IT staff will advise clients of the most suitable facilities in which to carry the conference.

IT Technical Liaison
IT will serve as technical liaison with teleconference distributors to assure compatibility with UofL reception equipment.

IT serves as the official UofL technical representative to Kentucky Educational Television (KET) Satellite Operations.

It is the responsibility of IT to review all requests for satellite reception equipment prior to processing by the Purchasing Department. The Satellite Communications Equipment Justification form is available from IT.

IT Hours, Locations, and Phone
The Satellite Downlink Coordinator is available Monday through Friday, 8:00am to 4:00pm at 502/852.6090.

The Belknap Campus Media Support Center is open Monday through Friday, 8:00 a.m. to 4:30 p.m. The office is located on the Belknap Campus in the west wing of Strickler Hall, Room 105. The telephone number is 852-6465.

The Health Sciences Campus Media Support Center is open Monday through Friday, 8:00 a.m. to 5:00 p.m. The office is located on the Health Sciences Campus in Building B, Room 224. The telephone number is 852-7476.

Network Affiliations

KET/Star Channels
IT serves as one of eight field production centers in the Commonwealth for Kentucky Educational Television (KET), the state educational television network. In cooperation with the KET network, interactive videoconferencing is conducted between 1600 downlink sites state-wide and KET in Lexington.

KCPE Telecommunications Consortium
The Kentucky Council on Postsecondary Education (KCPE) Telecommunications Consortium includes representation from the eight public universities, a representative of the UK Community College System (13 colleges), a representative of the twenty independent institutions, and a representative of Kentuckiana Metroversity. The KCPE Telecommunications Consortium emphasizes the use of communications systems to meet the needs of the non-traditional learner with concentration on higher education telecourses and other delivery systems such as teleconferencing. National ITFS Association
The National ITFS Association (NIA), a Washington-based consortium, is dedicated to the national delivery of educational materials through the medium of Instructional Television Fixed Service (ITFS). IT is a member of NIA and operates a four channel ITFS system which provides the final mile delivery mechanism from our satellite antennas for teleconferences serving the University of Louisville community.

IT Responsibility
Information Technology (IT) will provide an accurate estimate for IT services contracted for teleconferencing prior to the program, assist the site coordinator with details and arrangements for the program, negotiate contracts directly with teleconference distributors, and routing contracts through University Counsel. IT clients should receive copies of all contracts and agreements.

Client Responsibility
Teleconference clients are responsible for coordinating program arrangements, catering through University Catering (852-6715), collecting fees, and making disbursements. Teleconference clients are responsible for providing a site coordinator to be present at the teleconference to oversee registration, provide official greetings, and other administrative details (this includes any telephone charges associated with the coordination and viewing of the program).

Required Information
When making reservations for teleconferencing services, please provide as much of the following information as possible:

1. Title of the teleconference.
2. Satellite name, identify C or Ku band, transponder number, channel, polarity (horizontal or vertical), video and audio frequency.
3. Broadcast date/time (noted in eastern time) and local program segment times.
4. Originating network, producing and originating site.
5. Test signal dates and times.
6. Contact name and phone number for technical problems.
7. Preferred viewing location.
8. Name of contact person, phone, and department requesting service.
9. Complete billing address (including a telephone number).

Payment Procedures
IT will invoice clients within 30 days of the teleconference. Internal payments to IT should be made according to the established UofL requisition process. External clientele are expected to make payment within 30 days of receipt of invoice. State agencies will be billed through the inter-agency billing procedure.

Regulation of Use
Public viewing of satellite communications is governed by the Federal Communications Commission (FCC) and Federal Copyright legislation. All requests for satellite reception services will be addressed in the context of these requirements and will require the appropriate written permission of the distributor and/or copyright holder prior to viewing. IT reserves the right to refuse any and all service requests.

Limits of Liability Satellite Transmissions
The client shall agree that the University of Louisville shall not be liable for failure to perform any of its duties under the teleconferencing agreement for reasons beyond its control, including but not limited to: (a) inability to acquire or transmit satellite signals; (b) strikes, boycotts, lockouts, or other labor trouble; (c) any storm, fire, earthquake, flood, or other Act of God; (d) any riot, civil disturbance, or any act of war; (e) any shortage, unavailability or disruption in the supply of labor, materials, fuels, or disruption of postal, electrical, telephone, or other utility service; (f) any present or future governmental law or ordinance, order, rule, or regulation or other cause or contingency beyond the University of Louisville's control.

Clients agree to indemnify, defend, and hold harmless the University of Louisville and its officers, agents, employees, and students from liability for any claim by any third party ensuing out of the performance by clients or UofL of the terms of teleconference agreements. Claims covered by the aforementioned indemnification shall include, but not be limited to, claims by third parties of defamation or of violations of property rights, copyrights, or rights of privacy arising out of publication, translation, reproduction, delivery, performance, uses or disposition of the taped program co-produced by the parties under the agreement.

The payment of a registration fee to see a program transmitted by satellite cannot be distinguished legally from the purchase of a theater ticket. Compensation for ordinary breach (i.e. malfunctions causing cancellation) is limited to actual damages, the measure of which is the amount of the registration fee.

Agreements shall be construed under the laws of the Commonwealth of Kentucky.
