The Kentucky Supreme Court held that the state auditor violated the separation of powers in trying to review the financial records of the Kentucky Bar Association, an agency of the courts. It ruled that “the judicial branch of the Kentucky state government has exclusive authority to manage its own affairs. The authority of the chief justice to submit the budget for the court of justice comes directly and expressly from the Kentucky Constitution itself. Ky. Const. § 110(5)(b). Hence that function can be neither assumed by nor delegated to the executive branch.”
