Freedom of Information Act (FOIA) and Privacy Act

Covered Employees:

Public employers.

Requirements:

Public employers must maintain public records and make them accessible both to employees and the public as required by law.  Even though these laws do not apply to private employers, many states have laws requiring private employers to retain documents that are part of the personnel file and to permit employees to inspect and copy their personnel files.
