PER-4.03 May 1, 1992 Holidays
I. POLICY AND/OR OBJECTIVE
The University observes the following holidays:
- New Year's Day,
- Martin Luther King Day,
- Memorial Day,
- Independence Day,
- Labor Day,
- Thanksgiving Day and the following Friday,
- Christmas Day,
- Tuesday after the first Monday in November in Presidential election years.
The President of the university may authorize additional holidays and extend the length of any holiday. The dates of holiday observance will be announced by the Office of the President.
Classified employees required to work on any of the following seven designated holidays (New Year's Day, Martin Luther King Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day) will be paid at a rate of one-and-a-half times their regular straight-time pay rate for the hours worked and in addition will be:
- credited with additional compensatory leave to equal the time worked on the holiday; or
- paid at an additional straight-time rate for the time worked on the holiday.
Classified employees required to work on other holidays will be paid at a straight-time rate for the hours worked plus compensatory leave or additional pay at a straight-time rate not to exceed the normal workday. Compensatory leave of a normal straight time rate cannot exceed the holiday time to which the employee would otherwise be entitled. The decision to allow compensatory time off or pay is reserved for the appropriate unit head. Should overtime hours occur in the week in which the holiday was worked, any overtime hours will be paid at time and one-half the regular straight time rate. Premium pay for holidays worked and overtime will not be duplicated.
University-designated holidays will be observed on the calendar day on which each holiday falls, except that a holiday falling on Saturday will be observed on the preceding Friday and a holiday falling on Sunday will be observed on the following Monday. Employees who are regularly scheduled to work on a seven-day-per-week operation will observe Saturday and Sunday holidays on the day which they fall, rather than the preceding Friday or following Monday.
Supervisors are encouraged to be sensitive to the importance of religious holidays to employees. Every effort should be made to allow employees to observe religious holidays. This may be done by allowing employees to substitute a "traditional" holiday for a religious holiday, or by using personal leave, compensatory time, annual leave, or leave without pay.
Holidays are considered to extend over a 24-hour period beginning at midnight. Holiday pay will be provided for all hours worked during that period.
To be paid for a holiday, the employee must be in pay status the last scheduled day of work prior to the holiday and the first scheduled day of work after the holiday. Employees will not be eligible for holiday pay during the payment of terminal leave.
Holiday pay is granted on a proportional basis for employees on a fixed, part-time basis of at least 50 percent of the normal full-time working schedule of the department in which he or she is employed. Employees working at least 40 percent of the full-time equivalency as of May 1, 1992, will receive holiday pay as long as they remain on at least 40 percent FTE.
